Clause Two in the Bill Preventing Illegal Infiltration - The Last Resort Against a Demographic Change in Israel - By Attorney Idan Abuhav

Approximately 60,000 illegal infiltrators entered Israel in the last several years from Sudan and Eritrea. Unlike other foreigners who came to Israel to work, these groups came with one purpose, to put down roots, raise families and reunite with their families once they are settled. In other words, these infiltrators have come to conquer the State of Israel and establish a new state over the existing one. Today there are already a number of cities where over 10,000 illegal infiltrators reside, including Tel Aviv, Eilat, Bnei Berak and Petach Tikva. Another worrying fact is that one in ten children in Tel Aviv is of African origin, and the birth rate is consistently rising. There are schools which are completely populated by children of illegal infiltrators, all at the expense of the Israeli child.

The government and the Knesset came to the late realization that these are not migrant workers who came to earn some money and return to their country of origin, but people who have come to live in Israel permanently. As a measure to combat the situation a fence was built on the Southern border at a cost of billions of Shekels. This money could have been used to purchase bullet proof vests and sophisticated means for our brave soldiers, for the benefit of Israeli children's education, or to improve the health services for all Israeli citizens.

As it is clear that a fence is not the solution, the government enacted a bill to prevent illegal infiltration. The bill is intended to deter new infiltrators and to ensure that those already in Israel exit. Left wing organizations petitioned the Supreme Court against the State of Israel's right to defend its borders, its demographics and its Jewish identity.
At a time when the world is drowning in a stream of immigrants - Europe with Muslim and African immigrants and the United States with immigrants from South America, the Israel Supreme Court decided to favor liberal values over defending the State of Israel. The Supreme Court overturned the Bill to prevent illegal infiltrators three times, acting against its own decisions in previous years regarding the right of the State to protect its borders from illegal immigration, at a time when Zionism was no less important that liberalism, humanism and politically correct, a time when the words Jewish State were not racist, but a legitimate expression.

Following the Supreme Court's ruling Israel is defenseless against new waves of immigration. In Israel today any individual who enters will be sent to an open facility for a period of one year, thereafter he is able to move to Tel Aviv, find work, start a family and remain in Israel indefinitely.
Last week the Legal Forum for Israel brought the Justice Minister's attention to the fact that there is a clause in the Israeli law which has not been overturned by the Supreme Court which imposes up to five years in prison on an illegal infiltrator entering Israel. This clause is often exercised against infiltrators from Arab countries or Gaza, but not against infiltrators from African countries. In the Israeli judicial system there are many supporters of these African infiltrators who do not wish to see them behind lock and key and therefore they oppose imposing this clause.
Following the Forum's request Justice Minister Shaked has stated that she supports the implementation of this clause and now it remains to be seen whether this will be the case. The Legal Forum will continue to do all in its power to ensure that the clause be enforced and any infiltrators who will break the law and climb over the fence into Israel will be imprisoned for several years.

The Legal Forum will not rest and is determined to do all in its power to continue and protect the Jewish identity of the State of Israel. In order to accomplish this we need a strong Legal Forum for Israel.
